Denver Guidance on Coming Soons

What you need to know

The Clear Cooperation rule dictates that every listing must be submitted to the REColorado/PPAR MLS within one business day of ANY public marketing. This includes signage, word of mouth marketing, social media posts (even if they were since taken down), emails, and texts, for all properties that are for sale or for lease, including new construction. Public marketing by the seller directly will also trigger the policy. The MLS has a zero tolerance policy for infractions, and agent violations can result in all agents in the office facing consequences. It is strongly recommended to post the listing to the REColorado as a Coming Soon prior to ANY marketing of the property. Click Here for the most up-to-date information and regulations.

Please get the appropriate documentation signed by your seller for every Coming Soon listing and send the waiver to the MLS if your seller has opted for a Private Exclusive. Keep in mind that you may never market or advertise a property without having a signed exclusive right to sell listing contract with the Seller.

Here are a few more important details to know about the new Coming Soon status on the MLS:

  • A listing can remain in the Coming Soon status for up to 7 days

  • After 7 days, the Coming Soon listing will be automatically changed to active and DOM will start to accrue

  • If you are not ready to go active after 7 days in the Coming Soon status, the property should be marked as withdrawn and cannot continue to be marketed as a Coming Soon 

  • No showings are allowed in the Coming Soon status 

  • When a listing is in the Coming Soon status it does not accrue DOM

Listings pre-marketed on Compass.com see 2x more consumer views and 3x more agent views than listings with no pre-marketing.

Lengthen your pre-marketing timeline to 10 days by adding the property to Compass.com as a Coming Soon on a Friday. You’ll gain a few extra days of pre-marketing over the weekend before you’re required to post it on the MLS the following Monday. What you need to know

Any listing that is publicly marketed must be submitted to IRES within one business day. Please get the appropriate documentation signed by your seller for every Coming Soon listing and send the waiver to the MLS if your seller has opted for a Private Exclusive. Aspen does not have a Coming Soon status in the MLS. Any listing that is publicly marketed must be submitted to the MLS within one business day. Please get the appropriate documentation signed by your seller and send the waiver to the MLS if your seller has opted for a Private Exclusive. Vail Guidance

What you need to know

Please submit the listing as a Coming Soon to VMLS prior to ANY public marketing to avoid infractions: Coming Soon Information.

You can take advantage of Coming Soon marketing for a maximum of 30 days.  You can shorten this period at any time if your client wants to go from Coming Soon to Active, by simply changing the status on VMLS from Coming Soon to Active.

Private Exclusives

A Private Exclusive listing is an off-market home that can be shared by a Compass agent directly with their colleagues and their buyers. Property details aren’t disseminated widely and won’t appear public home search websites. You cannot publicly market a Private Exclusive.

All listings that you would like to pre-market for more than one business day should be posted as a Private Exclusive. Use this one-pager in Marketing Center to educate your clients about Private Exclusives.
